|Issues with variables carrying

On InsaneJournal, I have run into many issues where variables processed from within the |
section of a bml page. Are used between <?_code _code?> tags
This is affecting a few things. For example, in the file directory.bml the $head variable that sets an auto-refresh is not getting passed down the the HEAD<= section. Also some crumbs are not being set before the bml is parsed so the crumb stuff in the body of the .look file is coming up empty.
Personally Im fond of the way some pages are coded to have a big &;lt;?_code _code?> that sets a $body and $head variable then they are used in the <?page page?> below (login.bml for example).
Im using apache 1.3.28, mod_perl 1.28 and perl 5.8.0.
This is happening on both my dev(FreeBSD 4.9) and live box(Redhat 7,2 with 2.4.18 kernel)
so it seems to be platform independant.
